Background and Recommendation:
-There was acceptance in principle of the addtional JBVMM force requirements outlined by General Somoro Mohammed Younis in Janaury 2013 (Chief of Staff Ethiopian Armed Force).
-Kadugli was accepted as a suitable temporary JBVMM HQ before moving to final location in Abyei.
-There was acceptance that there would be no move of the JBVMM HQ to Abyei until the Temporary Arrangements were implemented and accommodation provided by UN.

4. Deployment and Employment of Teams and Team Sites:
4.1 The number of team sites and teams in a Sector will change based on current and future joint security assessments. JBVMM HQ can establish team sites within SDBZ with notifications to the JPSM and any establishment of new team sites outside the SDBZ will be with the consent of the two JPSM Co-Chairs. The total number of monitors authorized will be 90, as per JPSM decisions of 18 September 2011 and UNSC resolutions 2024, with an initial strength of 70, which will be built up as per progress of operationalization.

6. Timeline
6.1 IOC: South Sudan has agreed to provide land within 16 days (from 10 March 2013) at Gok Machar, Sudan agreed for immediate use of land in Kadugli for the JBVMM HQ and Sector HQ. The JBVMM will operate immediately from Kadugli, within its capabilities. In Gok Machar, IOC will be operational within 30 days of provision of land.
6.2.1 FOC:

Page 6-7, Operationalization of JBVMM
1. Governments of Sudan and South Sudan agreed to the requirement of force protection battalion of 860 personnel and 266 military support component.
2. Government of Sudan and South Sudan agreed to resolved the land allocation for JBVMM Sector HQ in Gok Machar within 16 days from 10 March 2013.
3. 30 Days after this 16 days period the parties agreed that the JBVMM should complete IOC with a JBVMM Temporary HQ in Kadugli and a Sector HQ each in Kadugli and Gok Machar. Sector HQ and Teams at Kadugli will be operational immediately on deployment, whereas the Sector HQ at Gok Machar will be operational by D-Day +46 Days.
4. The Parties agreed that JBVMM will have final strength of 90 monitors each as per JPSM decisions of 18 September 2011 and UN Security Council Resolution 2024 of 14 December 2011. They will initially deploy 70 monitors and build up this strength progressively as per progress of operationalization.
5. New Sector HQ sites for FOC agreed by both Parties are Malakal in South Sudan and Buram in Sudan. Force generation for FOC will be done within 60 days from 10 March 2013. Operationalization of FOC will be within 90 days. The Parties agreed to provide land at Malakal and Buram within 30 days from 10 March 2013.
Comment: 1. Deployment of force protection battalion is contingent upon the date of approval by UNSC; 2. There are no planned team sites during IOC, teams will operate using helicopters from HQs

In accordance with the commitment to establish a Standing JPSM Secretariat as stipulated in the Agreement on Security Arrangements of 27 September 2012 and the Agreement on the Border Monitoring Support Mission of 30 July 2011, this Secretariat will receive concerns and complaints of the Parties and forward them to the Co-Chairs for allocation to the appropriate competent authority: the JBVMM; the Ad-Hoc committee; the Ad-Hoc Committee of the JBVMM Sector HQ (for the 14 Mile Area); the JPSM Co-Chairs themselves; or a new ad-hoc or sub-committee should be created by the JPSM. The Ad-Hoc Committee and the Secretariat shall have a permanent office in Khartoum and Juba and ensure a permanent link between the two, including liaison visits.

Where there is a requirement for additional evidential detail and no mechanism for investigation already exists to perform the investigative functions proposed in Column (h) the JPSM Secretariat will process the evidential detail for columns (c) to (f) in the matrix and report to the Co-Chairs for further action. Concerns and Complaints Submitted to JPSM Co-Chairs
In accordance with the commitment to establish a Standing JPSM Secretariat as stipulated in the Agreement on Security Arrangements of 27 September 2012 and the Agreement on the Border Monitoring Support Mission of 30 July 2011, this Secretariat will receive concerns and complaints of the Parties and forward them to the Co-Chairs for allocation to the appropriate competent authority;
the JBVMM;
the Ad-Hoc committee;
the Ad-Hoc committee of the JBVMM Sector HQ (for the 14 Mile Area);
the JPSM Co-Chairs themselves;
or a new ad-hoc or sub-committee should be created by the JPSM.
The Ad-Hoc Committee and the Secretariat shall have a permanent office in Khartoum and Juba and ensure a permanent link between the two, including liaison visits.
Where there is a requirement for additional evidential detail and no mechanism for investigation already exists to perform the investigative functions proposed in column (h) the JPSM Secretariat will process the evidential detail for columns (c) to (f) in the matrix and report to the Co-Chairs for further action.
In relation to current complaints and concerns a report will be made by the JPSM Secretariat to the Co-Chairs by 6 February 2013.
Reports on all concerns and complaints contained in the matrix are to be made by the appropriate authority (as mentioned above) to future meetings of the JPSM as part of the formal agenda:

The parties agree to operationalization of the agreed mechanisms, and consistent with agreements any of the parties may lodge, at any time, concerns or complaints with the JPSM Co-Chairs, which shall be addressed.
Concerns or complaints relating to the SDBZ shall be referred to the JBVMM, concerns or complaints relating to the 40km either side of the SDBZ shall be referred to the AD-hoc committee and for concerns or complaints beyond the border area the Co-Chairs shall form additional subcommittees, mechanisms or principles as deemed necessary.
Article 8 of the MoU:
‘The two States hereby authorize the JPSM to oversee Compliance with this Memorandum.
The Parties may adopt further mechanisms and principles to enable the JPSM to carry out functions.
In the event of any dispute arising in the implementation of the MOU, the two States shall seek to resolve the matter amicably through the JPSM.’
