Exchange of Letters on Aspects related to Navigation of Gaps in Rivers and the Napo River

Lima, 26th of October,1998.
His Excellency the Minister:
I have the honour of addressing Your Excellency, in relation to aspects related to navigation of gaps in rivers and the Napo river that were addressed during talks held under the ltamaraty Peace Declaration.
In this context, my Government is in agreement that in the stretches of the bordering rivers between both countries, and in particular in the Napo river sector, in the part between the rivers Yasuní and Aguarico, and in the Güepi and Curaray rivers, vessels flying the flag of' any of the Parties may use the most suitable navigation canal, even when, because of a bend, it does not coincide with the established boundary.
This navigation will be performed peacefully and without being interrupted.
Vessels will not be detained or denied passage without a justified reason and will not have the right to stop along the banks of rivers located in the territory of another country.
The above rules will govern navigation of bends in rivers of the Amazon region whose courses cross the border line between the two parties.
The Parties will take measures to prevent and suppress offenses in the border rivers or course belonging to their respective territorial jurisdiction.
They will collaborate with the other Party by adopting appropriate measures to suppress crimes that have been committed in the territory of said other Party.
The present, and the letter that with the same tenor Your Excellency will please respond with, will constitute an Agreement between our two countries, and will enter into force simultaneously with those others that are signed on the same date and are part of the global and definitive solution referred to in the Implementation of the Brasilia Declaration Timetable, agreed by the Parties on the 19th of January, 1998 and under the conditions set out in it.
I take this opportunity to renew to Your Excellency the assurances of my highest and most distinguished consideration.
